Walnut Brook Estates Association Bylaws
Walnut Brook Estates homes shall not be substantially similar in exterior design and appearance to any other residence within the development which has received Architectural Control approval. The primary basis for determination of similarity will be proportion and massing of architectural elements, location and style of windows and front entrance areas, rooflines, and exterior colors and materials.
All driveways shall be paved with asphalt, brick pavers or dark tinted exposed aggregate concrete, and shall be completed prior to occupancy. Standard concrete driveways are prohibited. No front entrance garages shall be erected or maintained, and all garages shall be attached to the main dwelling. The Developer shall have the sole and conclusive authority to determine what constitutes a front entrance garage. No driveway for a Unit shall be located within ten (10) feet of a side lot line of the Unit from the point at which the driveway intersects the Road to a point twenty (20) feet into the Unit, except that the Developer may direct that a driveway be located within such area when the existing landscaping so dictates in the Developer's sole judgment. Garages shall be located on the opposite side of the typical approach direction to a Unit. All garage doors shall be operated with automatic garage door openers.
Each Unit and surrounding Limited Common Element Yard Area must be landscaped within the time limits set forth in paragraph C of this Section 2. Plans submitted must include reasonably mature landscaping and the Developer shall have the right to determine the reasonable value of the landscaping.
No above-ground swimming pools shall be erected or maintained on any Unit or surrounding Limited Common Element Yard Area. The size, configuration, location and exterior appearance of any in-ground swimming pool shall be subject to the Developer's prior written approval.
No fence, wall or hedge of any kind shall be erected or maintained on any Unit without the prior written approval of the Developer. No fence, wall or hedge shall be located nearer to any front Homesite than is permitted for dwellings under subparagraph (2) of this paragraph B. No fence, wall or hedge shall be maintained or erected along a HomeSite's boundaries or which blocks or hinders vision at street intersections. No chain link fences shall be permitted on any Unit or surrounding Limited Common Element Yard Area.
